At this point, many people have heard of Johnson and Johnson products causing cancer. 43 of these cases have been extremely high profile and have been brought against Johnson & Johnson in federal courts. The U.S. JPML (Judicial Panel on Multidistrict Litigation) ordered that these claims be centralized in October of 2016. The other claims were mostly filed in state court systems. With the unification of these claims, a consolidated MDL or Multidistrict Litigation is formed.
MDLs can be a benefit for cases like these because it can lower the amount of overlapping or duplicative discovery that occurs. It can also lower the chances that different judges will rule differently on essentially the same claims and cases. In the case of Johnson and Johnson products causing cancer, the MDL will also result in bellwether trials, which — if successful — can positively indicate similar results in future litigation or will lead right away to settlements.
